หนังสือแจ้งสิทธิในการเก็บรวบรวม ใช้ และเปิดเผยข้อมูลส่วนบุคคล (Privacy and Consent Form)
บริษัท บี. บราวน์ (ประเทศไทย) จำกัด (“บริษัทฯ”) มุ่งมั่นและยึดมั่นในการให้คุ้มครองข้อมูลส่วนบุคคลของผู้ใช้บริการ คู่สัญญา พันธมิตรทางธุรกิจ บริษัทในเครือ และพนักงานทุกฝ่ายที่บริษัทฯ ได้ทำการติดต่อด้วย การเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูล โดยเฉพาะข้อมูลส่วนตัวหรือข้อมูลส่วนบุคคล
(“ข้อมูลส่วนบุคคล”) นั้นจะได้รับความคุ้มครองตามมาตรฐานที่พระราชบัญญัติคุ้มครองข้อมูลส่วนบุคคล พ.ศ. 2562 (“กฎหมาย”) กำหนดไว้ ซึ่งเป็นเรื่องที่บริษัทฯ ตระหนักและให้ความสำคัญเป็นอย่างมาก ซึ่งท่านในฐานะเจ้าของข้อมูลส่วนบุคคลสามารถรับทราบรายละเอียดนโยบายความเป็นส่วนตัวได้ที่ https://www.bbraun.co.th/th/privacy-policy.html
บริษัทฯ จึงจัดทำหนังสือฉบับนี้ขึ้นโดยมีวัตถุประสงค์แจ้งให้ท่านทราบถึงสิทธิเกี่ยวกับข้อมูลส่วนบุคคลและเพื่อรับรองว่าสิทธิของท่านนั้นจะได้รับการคุ้มครองตามกฎหมาย และเพื่อให้ท่านยินยอมให้บริษัทฯ รวมถึงบริษัทในเครือ บริษัทตัวแทนจำหน่ายหรือผู้จัดจำหน่ายของบริษัทฯ เก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคลที่มีอยู่กับบริษัทฯ ภายใต้ข้อกำหนดและเงื่อนไข ดังต่อไปนี้
ข้อกำหนดและเงื่อนไข
ประเภทข้อมูลส่วนบุคคล
ข้อมูลส่วนบุคคล หมายความว่า ข้อมูลเกี่ยวกับบุคคลซึ่งทำให้สามารถระบุตัวบุคคลนั้นได้ไม่ว่าทางตรงหรือทางอ้อม แต่ไม่รวมถึงข้อมูลของผู้ถึงแก่กรรม
ข้อมูลส่วนบุคคลที่มีความอ่อนไหว หมายความว่า ข้อมูลที่ระบุตัวบุคคลได้เฉพาะเจาะจงมากขึ้น เช่น เชื้อชาติ เผ่าพันธุ์ ความคิดเห็นทางการเมือง ความเชื่อในลัทธิ ศาสนาหรือปรัชญา พฤติกรรมทางเพศ ประวัติอาชญากรรม ข้อมูลสุขภาพ ความพิการ ข้อมูลสหภาพแรงงาน ข้อมูลพันธุกรรม ข้อมูลชีวภาพ ฯลฯ
หรือข้อมูลอื่นใดซึ่งกระทบต่อเจ้าของข้อมูลส่วนบุคคลในทำนองเดียวกันตามที่คณะกรรมการคุ้มครองข้อมูลส่วนบุคคลประกาศกำหนด
วัตถุประสงค์การเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคล
เพื่อบริการให้ตรงตามต้องการของท่าน บริษัทฯ จะเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคลของท่าน เพื่อที่ท่านจะสามารถได้รับผลิตภัณฑ์และ/หรือบริการที่ตรงตามวัตถุประสงค์ของท่านตามสัญญา
กฎหมาย หรือตามที่ท่านร้องขอในกรณีดังต่อไปนี้
- การพิจารณาอนุมัติ และ/หรือ ให้บริการต่าง ๆ เช่น การลงทะเบียนเป็นผู้ซื้อหรือผู้ใช้บริการผลิตภัณฑ์หรือบริการของบริษัทฯ รวมถึงการเปิดบัญชีซื้อขาย และอื่น ๆ
- การดำเนินการใด ๆ ที่เกี่ยวข้องกับการให้ผลิตภัณฑ์ และ/หรือ บริการต่าง ๆ เช่น การติดต่อ การแจ้ง การโอนสิทธิและ/หรือหน้าที่แก่บุคคลภายนอก การอบรม การซ่อมบำรุงผลิตภัณฑ์ หากท่านปฏิเสธไม่ให้ข้อมูลแก่บริษัทฯ อาจทำให้บริษัทฯ ไม่สามารถจัดหาผลิตภัณฑ์ และ/หรือ ให้บริการแก่ท่านได้
- เพื่อปฏิบัติหน้าที่ตามกฎหมายไม่ว่าในประเทศไทยหรือต่างประเทศ เช่น กฎหมายที่เกี่ยวข้องกับการจัดจำหน่ายหรือให้บริการผลิตภัณฑ์ทางการแพทย์ กฎหมายที่เกี่ยวข้องกับการให้บริการทางการแพทย์ กฎหมายภาษีอากร กฎหมายป้องกันและปราบปรามการฟอกเงิน กฎหมายคอมพิวเตอร์ ฯลฯ
รวมถึงการปฏิบัติตามคำสั่งของหน่วยงานหรือเจ้าหน้าที่ผู้มีอำนาจตามกฎหมายไม่ว่าในประเทศไทยหรือต่างประเทศ หากท่านปฏิเสธไม่ให้ข้อมูลแก่บริษัทฯ อาจทำให้บริษัทฯ ไม่สามารถจัดหาผลิตภัณฑ์
และ/หรือ ให้บริการแก่ท่านได้ - เพื่อประโยชน์โดยชอบด้วยกฎหมายของบริษัทฯ หรือของบุคคลหรือนิติบุคคลอื่น อาทิ มาตรการรักษาความปลอดภัย การรักษาความสัมพันธ์กับท่าน การบริหารความเสี่ยง การกำกับตรวจสอบ การบริหารจัดการภายในองค์กร รวมถึงการป้องกันการกระทำผิดกฎหมาย การรักษาความปลอดภัยของข้อมูลส่วนบุคคล วัตถุประสงค์ทางธุรกิจ เป็นต้น ในกรณีที่ท่านปฏิเสธไม่ให้ข้อมูลแก่บริษัทฯ อาจทำให้บริษัทฯ ไม่สามารถให้บริการแก่ท่านได้อย่างมีประสิทธิภาพเท่าที่ควร
- เพื่อให้ท่านได้รับประโยชน์จากการใช้ผลิตภัณฑ์ และ/หรือ บริการ ตามที่ท่านได้ให้ความยินยอมไว้ เช่น เพื่อให้ท่านได้รับผลิตภัณฑ์ และ/หรือ บริการที่ดียิ่งขึ้นและสอดคล้องกับความต้องการของท่าน
เพื่อให้ท่านได้รับข้อเสนอ สิทธิประโยชน์พิเศษ คำแนะนำ และข่าวสารต่าง ๆ รวมถึงสิทธิในการเข้าร่วมกิจกรรมพิเศษ เป็นต้น ในกรณีที่ท่านปฏิเสธไม่ให้ข้อมูลแก่บริษัทฯ อาจทำให้บริษัทฯ ไม่สามารถให้บริการแก่ท่านได้อย่างมีประสิทธิภาพเท่าที่ควร
แหล่งที่มาของข้อมูลส่วนบุคคล
- จากท่านโดยตรง เช่น ข้อมูลที่ท่านกรอกขณะลงทะเบียนกับบริษัทฯ ข้อมูลที่ใช้ในการสมัครใช้บริการสมาชิก Salesforce ข้อมูลบัญชีผู้ใช้งาน (Account) หรือข้อมูลที่ท่านได้แก้ไขปรับปรุงในข้อมูลบัญชีผู้ใช้งาน (Account) ของท่าน ข้อมูลที่ได้จากการที่ท่านติดต่อกับบริษัทฯ หรือทีมงานของบริษัทฯ
เช่น ตัวแทนฝ่ายขาย ข้อมูลจากการใช้ผลิตภัณฑ์ และ/หรือ บริการของบริษัทฯ การติดต่อ เยี่ยมชมผ่านเว็บไซต์ Call Center และช่องทางอื่น ๆ ของบริษัทฯ ตลอดจนข้อมูลในการร่วมกิจกรรมต่าง ๆ ในแพลตฟอร์มหรืองานสัมมนา เป็นต้น - เทคโนโลยีการติดตาม (Tracking technology) เมื่อท่านใช้งานเว็บไซต์และแอพพลิเคชั่นของบริษัทฯ
- บริษัทในเครือไม่ว่าในหรือต่างประเทศ
- พันธมิตรทางธุรกิจไม่ว่าในหรือต่างประเทศ
- บุคคลภายนอก เช่น หน่วยงานของรัฐ สถาบันการเงิน ผู้จัดจำหน่าย ตัวแทน นายหน้า
และคนกลางอื่น ๆ ผู้ให้บริการข้อมูลโซเชียลมีเดีย แพลตฟอร์ม และผู้ให้บริการโฆษณาต่าง ๆ ไม่ว่าในหรือต่างประเทศ
ทั้งนี้ เพื่อประโยชน์ในการปรับปรุงข้อมูลส่วนบุคคลของท่านให้เป็นปัจจุบัน และเพื่อปรับปรุงคุณภาพและประสิทธิภาพของผลิตภัณฑ์และการให้บริการของบริษัทฯ ให้ดียิ่งขึ้น
ระยะเวลาในการเก็บรวบรวมข้อมูลส่วนบุคคล
บริษัทฯ จะเก็บรักษาข้อมูลส่วนบุคคลของท่านไว้เป็นระยะเวลาเท่าที่จำเป็นเพื่อการดำเนินการตามวัตถุประสงค์ที่ระบุไว้ในนโยบายความเป็นส่วนตัวนี้ให้เสร็จสิ้น เว้นแต่กรณีที่กฎหมายกำหนดหรืออนุญาตให้เก็บรักษาข้อมูลไว้นานกว่า ซึ่งมีกำหนดระยะเวลาไม่เกิน 10 ปี หรือระยะเวลาสูงสุดตามที่กฎหมายกำหนด เช่น ตามอายุความที่กฎหมายกำหนดสำหรับเรื่องที่เกี่ยวข้อง เพื่อการดำเนินคดี หรือเพื่อการตรวจสอบของหน่วยงานที่กำกับดูแล
การเปิดเผยข้อมูลส่วนบุคคล
บริษัทฯ จะไม่เปิดเผยข้อมูลส่วนบุคคลต่อบุคคลใดโดยไม่ได้รับความยินยอมจากท่านก่อน
อย่างไรก็ดี ท่านรับทราบและยินยอมว่าเพื่อประสิทธิภาพในการให้บริการหรือเพื่อปฏิบัติตามกฎหมาย บริษัทฯ อาจเปิดเผยข้อมูลส่วนบุคคลของท่านให้กับบริษัทในเครือ พันธมิตรทางธุรกิจ ผู้ให้บริการประมวลผลข้อมูล ไม่ว่าในหรือต่างประเทศ หน่วยงานหรือเจ้าหน้าที่ของรัฐที่ใช้อำนาจหน้าที่ตามกฎหมาย โดยในการเปิดเผยข้อมูลส่วนบุคคลให้แก่บุคคลดังกล่าว บริษัทฯ จะดำเนินการให้บุคคลเหล่านั้นเก็บรักษาข้อมูลส่วนบุคคลของท่านไว้เป็นความลับ และไม่นำไปใช้เพื่อวัตถุประสงค์อื่นนอกเหนือจากขอบเขตที่บริษัทได้กำหนดไว้ รวมถึงมีการทำสัญญาระหว่างบริษัทฯ และบุคคลที่บริษัทฯ เปิดเผยข้อมูลส่วนบุคคลโดยให้มาตรฐานการเก็บรวบรวม ใช้ และเปิดเผยข้อมูลส่วนบุคคลเป็นไปตามหลักเกณฑ์ที่กฎหมายกำหนด
อย่างไรก็ดี หากท่านเชื่อว่าบุคคลที่บริษัทฯ เปิดเผยข้อมูลส่วนบุคคลของท่านตามข้างต้น
ได้มีการนำข้อมูลส่วนบุคคลไปใช้เพื่อวัตถุประสงค์อื่นนอกเหนือจากขอบเขตที่บริษัทฯ ได้กำหนดไว้ ท่านสามารถแจ้งบริษัทฯ ตามรายละเอียดที่ระบุไว้ในหนังสือแจ้งสิทธิในการเก็บรวบรวม ใช้ และเปิดเผยข้อมูลส่วนบุคคลฉบับนี้ เพื่อดำเนินการในส่วนที่เกี่ยวข้องต่อไป
การส่งหรือโอนข้อมูลส่วนบุคคลไปยังต่างประเทศ
บริษัทฯ อาจส่งหรือโอนข้อมูลส่วนบุคคล ที่บริษัทฯ ได้เก็บรวบรวม ใช้ หรือเปิดเผย ไปยังต่างประเทศ ซึ่งประเทศปลายทางหรือองค์การระหว่างประเทศที่รับข้อมูลส่วนบุคคลจะมีมาตรฐานการคุ้มครองข้อมูลส่วนบุคคลที่เพียงพอตามหลักเกณฑ์ที่กฎหมายกำหนด
สิทธิของเจ้าของข้อมูลส่วนบุคคล
- สิทธิในการถอนความยินยอม (Right to withdraw consent)
ท่านสามารถแก้ไขหรือเพิกถอนการให้ความยินยอมในการเก็บรวบรวม ใช้ และเปิดเผยข้อมูลส่วนบุคคลของท่านได้ตลอดเวลา ท่านสามารถขอ “คําขอถอนความยินยอม” เพื่อกรอกข้อมูลและส่งให้กับ คณะทำงาน PDPA ของบริษัทฯ ที่ pdpa.bbth.th@bbraun.com ทั้งนี้การลบข้อมูลอาจทำให้ท่านไม่สามารถรับบริการจากบริษัทฯ ได้ หรืออาจทำให้การให้บริการไม่มีประสิทธิภาพเท่าที่ควร ในกรณีที่มีการร้องขอให้เพิกถอนข้อมูลส่วนบุคคลของท่านจากระบบหรือฐานข้อมูลท่านของบริษัทฯ นั้น บริษัทฯ จะพยายามอย่างเต็มที่ตามความสามารถของระบบงานที่เกี่ยวข้องเพื่ออำนวยความสะดวกและดำเนินการตามคำร้องขอของท่าน เว้นแต่จะปรากฏข้อเท็จจริงว่าการดำเนินการตามคำร้องขอนั้นจะเสี่ยงต่อการละเมิดนโยบายความเป็นส่วนตัวของผู้ใช้หรือผู้ให้บริการรายอื่น หรือเป็นการขัดต่อกฎหมาย หรือมีความจำเป็นที่จะต้องเก็บข้อมูลไว้เพื่อเป็นพยานหลักฐานในการตรวจสอบหรือดำเนินคดีตามกฎหมาย เพื่อปฏิบัติตามหน้าที่ตามกฎหมายที่ใช้บังคับ หรือกรณีที่เป็นการพ้นวิสัยในทางปฏิบัติตามคำร้องขอของท่าน หรือบริษัทฯ มีสิทธิในการเก็บข้อมูลส่วนบุคคลของท่านไว้โดยการประมวลผลข้อมูลส่วนบุคคลฐานอื่นซึ่งกฎหมายได้ให้สิทธิไว้
การเพิกถอนความยินยอมของท่านจะไม่ส่งผลกระทบต่อการเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคลที่ท่านได้ให้ความยินยอมไปแล้วก่อนหน้านั้น - สิทธิได้รับการแจ้งให้ทราบ (Right to be informed)
ท่านมีสิทธิได้รับแจ้งรายละเอียดเกี่ยวกับการประมวลผลข้อมูลส่วนบุคคลโดยไม่ต้องมีการร้องขอ โดยบริษัทฯ มีหน้าที่แจ้งวัตถุประสงค์และรายละเอียดของการประมวลผลข้อมูลส่วนบุคคล อาทิ ประเภทของข้อมูลส่วนบุคคลที่ได้เก็บรวบรวม ระยะเวลาในการเก็บรวบรวม การส่งต่อหรือโอนข้อมูลส่วนบุคคล ช่องทางการติดต่อผู้ควบคุมข้อมูลส่วนบุคคล เป็นต้น - สิทธิในการเข้าถึงและรับสำเนาข้อมูลส่วนบุคคล (Right of access)
ท่านมีสิทธิขอเข้าถึง และขอสำเนาอิเล็กทรอนิกส์ของข้อมูลส่วนบุคคลได้ เช่น หนังสือรับรองการประมวลผลข้อมูลส่วนบุคคล ประวัติการรักษา ข้อมูลสุขภาพ เป็นต้น - สิทธิในการโอนย้ายข้อมูลส่วนบุคคล (Right to data portability)
ท่านมีสิทธิขอให้บริษัทฯ ทำการโอนข้อมูลส่วนบุคคลไปยังผู้ควบคุมข้อมูลอื่นได้ หากเป็นข้อมูลส่วนบุคคลที่ประมวลผลด้วยฐานความยินยอมหรือฐานสัญญาที่ถูกจัดระบบแล้ว และเป็นข้อมูลที่ประมวลผลด้วยระบบอัตโนมัติที่คอมพิวเตอร์สามารถอ่านได้ - สิทธิในการแก้ไขข้อมูลส่วนบุคคลให้ถูกต้อง (Right to rectification)
ท่านมีสิทธิร้องขอให้บริษัทฯ ทำการแก้ไขข้อมูลส่วนบุคคลให้ถูกต้อง เป็นปัจจุบัน และสมบูรณ์ได้ - สิทธิในการขอให้ลบหรือทำลายข้อมูลส่วนบุคคล หรือทำให้เป็นข้อมูลที่ไม่สามารถระบุตัวบุคคลได้ (Right to erasure / Right to be forgotten)
ท่านมีสิทธิร้องขอให้บริษัทฯ ลบหรือทำลายข้อมูลส่วนบุคคลได้ในกรณีที่ข้อมูลส่วนบุคคลนั้นไม่มีความจำเป็นในการประมวลผลตามวัตถุประสงค์ได้
การลบข้อมูลส่วนบุคคลจะไม่ส่งผลกระทบต่อการเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคลที่ท่านได้ให้ความยินยอมไปแล้วก่อนหน้านั้น - สิทธิในการระงับการประมวลผลข้อมูลส่วนบุคคล (Right to restrict processing)
ในกรณีที่ท่านไม่ต้องการเพิกถอนความยินยอมและไม่ต้องการลบข้อมูลส่วนบุคคลเพราะเห็นว่าการเก็บรวบรวมข้อมูลส่วนบุคคลของบริษัทฯ เป็นประโยชน์แก่ท่าน ท่านสามารถใช้สิทธิระงับการประมวลผลข้อมูลส่วนบุคคลได้
การระงับการประมวลผลข้อมูลส่วนบุคคลอาจทำให้ท่านไม่สามารถรับบริการจากบริษัทฯ ได้
หรืออาจทำให้การให้บริการไม่มีประสิทธิภาพเท่าที่ควร
การระงับการประมวลผลข้อมูลส่วนบุคคลจะไม่ส่งผลกระทบต่อการเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคลที่ท่านได้ให้ความยินยอมไปแล้วก่อนหน้านั้น - สิทธิในการคัดค้านการประมวลผลข้อมูล (Right to object)
ท่านมีสิทธิคัดค้านการประมวลผลข้อมูลส่วนบุคคลฐานภารกิจของรัฐ ฐานประโยชน์อันชอบด้วยกฎหมาย และฐานอื่นที่ไม่เห็นชอบด้วยได้ - สิทธิที่จะร้องเรียน (Right to complaint)
เมื่อการประมวลผลข้อมูลส่วนบุคคลมิได้เป็นไปตามกฎหมาย นโยบายการคุ้มครองข้อมูลส่วนบุคคล ท่านย่อมมีสิทธิร้องเรียนการดำเนินที่ละเมิดสิทธิความเป็นส่วนตัวได้ที่คณะทำงาน PDPA ของบริษัทฯ ที่ pdpa.bbth.th@bbraun.com

Braun (Thailand) Limited (“Company”) commits and adhere to protect personal data of user, contractual partner, affiliated company, business partner, distributor and employees that Company has collected, used and disclosed of information especially for personal data ("Personal Data") will be protected in accordance with Personal Data Protection Act B.E. 2562 (2019) (“Law”) which the matter that Company realizes and gives more precedence. Types of personal data
Personal data means individual data that identifiable person, either directly or indirectly but does not include the data of the deceased.
Sensitive Personal data means more personally identifiable data such as race, ethnicity, political opinions, religion or philosophy sexual behavior, criminal records, Health data, disability, labor union information, genetic data, biological data, etc. or any data that affects the subject of personal data in a similar manner as announced by the Personal Data Protection Committee.
Purpose of collecting, using and disclosing Personal data
In order to provide services, Company will collect, use or disclose your Personal. You will obtain products and/or services on the purpose of contractual, legal, or requested purposes in the following cases:
1. Consideration for approval and/or providing services such as registration as a purchaser or user of Company's products or services. including opening a trading account, etc.
2. Any providing related to the products and/or services such as contacting, notification, assignment of rights and/or duties to third parties, training, product maintenance.
If you refuse to provide Personal Data, Company may cannot provide product and/or service to you.
3. To comply with the laws whether in Thailand or abroad, such as laws related to the distribution, service of medical products, laws relating to the provision of medical services tax, Anti-Money Laundering laws, Computer laws, etc., Including compliance with orders of authorities or legal authorities whether in Thailand or abroad.
If you refuse to provide Personal Data, Company may cannot provide product and/or service to you.
4. For the Legal Legitimate of Company or other persons or juristic persons such as security measure, maintaining a relationship with you, risk management, supervision internal management including preventing illegal acts, security of Personal Data, business objective, etc.
In the event that you refuse to provide Personal Data, company may unable to provide services to you as efficiently as they should.
5. To using the product and/or service as you have given Consent e.g. for provide develop products and/or services with your purpose, for offer special benefits, advice and news, including the participate in special events, etc.
In the event that you refuse to provide Personal Data, company may unable to provide services to you as efficiently as they should.
Source of personal Data
- From you directly such as while registering with the company, account information (Account) or information that you have modified in your account information (Account), Personal Data from contacting with the company or the company's employee such as sales representatives, Personal Data from using Company's products and/or services, contacting and visiting via the website, Call Center and other channels of Company, as well as Personal Data on participating in various activities in the platform or seminars, etc;
- Tracking technology when visiting Company’s website and applications;
- Affiliated companies whether in domestic or abroad;
- Business partners, whether in domestic or abroad;
- Third parties such as government agencies, financial institution, distributors, agents, brokers and the other and
- Social media provider, platform and advertising service provider, whether in domestic or abroad.
This is for the benefit of updating your Personal Data up to date and to improve the quality and efficiency of the Company's product and service with better.
Period for collecting Personal data
Company will retain your Personal Data for as long as is necessary for the completion of the purposes stated in this Privacy Policy. Unless required or permitted by law to keep the Data as longer which is not more than 10 years, or maximum period as specified by law e.g. according to prescription for related matter in order to litigation or for inspection by government agencie.
Disclosing of Personal Data
Company shall not disclose Personal data to any person without your prior consent. However, you acknowledge and agree that for the effectiveness, service and comply with the law, Company shall disclose Personal Data to affiliated Company, business partner and Data Processing Service Provider whether in the domestic or international, agency or government that exercises legal powers and duties. In the event of disclosing Personal data to such persons, Company shall proceed for those persons to keep your Personal Data with confidential and not use for other purposes than the scope specified by Company including having Agreement between Company and such persons that Company has disclosed Personal Data for collecting, using and disclosing are in accordance with the rules prescribed by Law.
In any event, if you believe that the person whom Company disclose Personal data uses over than the scope specified by Company. You can notify to Company here by this Privacy Notice and Consent Form for collection, use and disclosure in order to proceed in the relevant part.
Cross-border Data Transfer
The Company shall transmit or transfer Personal Data that has collected, used or disclosed to abroad that the destination country or international organization whom received Personal data shall protect Personal data in accordance with the rules prescribed by Law.
Right of Data subject
1. Right to withdraw consent
You can revise or withdraw your consent for collection, use and disclosure of your Personal Data at any time. You can request a “Withdrawal Request Form” to fill in and submit to the PDPA Working Group of Company at pdpa_bbth.th@bbraun.com However, deleting the Data may restrict services from Company or inefficient as it should be.
In the event that you request to withdraw your Personal Data from the system or your database of Company, Company will do its best to the capability of the relevant system to facilitate and carry out. Unless that processing the request will risks to violate Privacy Policy of other user or service providers, against the law, need to keep Data for propose of investigation or legal action, to perform duties under law or in the case where it is impossible to practice at your request or Company has right to keep Personal Data by processing other bases that are permitted by law.
Withdrawing of your consent will not affect the collection, use or disclosure of Personal Data that you have previously given such consent.
2. Right to be informed
You have right to be informed about processing of Personal Data without requestion. Company has duty to inform the purpose and details of the processing of Personal Data such as type of Personal Data collected, collection period, forwarding or transferring Personal Data, channels to contact Data Controller etc.
3. Right of access
You have right to request for access and electronic copies of Personal data such as Personal Data Processing Certificate, Medical history Data, health Data, etc.
4. Right to data portability
You have right to request for transfer your Personal Data to another Data Controller, if Personal Data has processed with consent or contract base and automatically by a computer which can be read.
5. Right to object
You have right to request for revise Personal Data to be accurate, current and complete.
6. Right to erasure / Right to be forgotten
You have right to request for erase or destroy Personal Data in cases where the personal data is not necessary for purpose of processing.
Deletion of Personal Data will not affect the collection, use or disclosure of Personal Data that you have previously given such consent.
7. Right to restrict processing
In the event that you do not want to withdraw your consent or delete Personal Data because such Personal Data is benefit. You have right to restrain of Personal Data processing.
To retraining of Personal Data processing may restrict or ineffective services from Company as it should be.
Retraining of Personal Data processing will not affect the collection, use or disclosure of Personal Data that you have previously given such consent.
8. Right to rectification
In the event that you do not agree, you have the right to object by processing of Personal Data on Public Interest, Legal legitimate or other bases.
9. Right to complaint
In the event that processing of Personal Data is not align with Privacy Policy, you have the right to request of violent action with PDPA Working Group at pdpa_bbth.th@bbraun.com
